Welcome to Whisk Marketplace, your go-to destination for all your baking needs! These Terms and Conditions (“Terms”) govern your use of the Whisk Marketplace platform as a buyer. By accessing or using Whisk Marketplace, you agree to be bound by these Terms. Please read them carefully before using our services.
1. Definitions
“Whisk Marketplace” refers to the online platform operated by Whisk Marketplace that facilitates the buying and selling of baking supplies.
“Buyer” refers to any individual or entity using Whisk Marketplace to purchase baking supplies.
“Seller” refers to any individual or entity selling baking supplies on Whisk Marketplace.
2. Ordering and Payment
By placing an order on Whisk Marketplace, you agree to purchase the selected baking supplies at the specified price.
All prices listed on Whisk Marketplace are in Australian Dollars (AUD).
Payment for orders must be made using the available payment methods accepted by Whisk Marketplace.
Whisk Marketplace may use third-party payment processors to facilitate transactions. By using such processors, you agree to their terms and conditions.
3. Shipping and Delivery
Shipping and delivery of purchased items will be handled by the respective Sellers.
The Whisk platform will allow you to set your own shipping rules from the following options:
- Shipping by distance
- Free shipping
- Free shipping after seller selected spending amount reached
- Flat fee
- Free local pickup
- Charged local pickup
Whisk Marketplace is not responsible for delays in shipping or delivery caused by the Seller or third-party shipping providers such as Australia Post.
4. Returns and Refunds
Each Seller on Whisk Marketplace may have their own return and refund policies.
Buyers are encouraged to review the Seller’s return and refund policy before making a purchase. Each Seller is required to adhere to Australian Consumer Law.
In case of a dispute regarding returns or refunds, you are required to follow our Dispute Resolution Policy.
5. Product Quality and Liability
Whisk Marketplace endeavors to ensure the quality and accuracy of product listings; however, we do not guarantee the quality, accuracy, or suitability of any products sold by Sellers.
We do guarantee product quality and accuracy for products sold directly by the Whisk Store (and not a seller on Whisk)
Buyers are encouraged to review product descriptions, images, and reviews before making a purchase.
Whisk Marketplace is not liable for any damages, losses, or injuries resulting from the use of products purchased through our platform.
6. Prohibited Conduct
Buyers must not engage in any conduct that violates these Terms or infringes upon the rights of others.
Prohibited conduct includes but is not limited to: fraud, harassment, spamming, or unauthorised use of Whisk Marketplace.
Whisk Marketplace reserves the right to suspend or terminate the accounts of Buyers who engage in prohibited conduct.
7. Modifications to Terms
Whisk Marketplace reserves the right to modify these Terms at any time.
Any changes to these Terms will be effective immediately upon posting.
Continued use of Whisk Marketplace after the posting of modified Terms constitutes acceptance of the changes.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Australia.
